Conflicting evidence states that Robert was born 1817 at an unknown location. When Robert was age 34 and Mary PAYNE was age 24 they became the parents of Levi PAYNE June 28, 1853 at Bonne Bay, District of St. Barbe, Newfoundland. Born after January 16, 1855 and before January 16, 1856, due to being age 42 years at the time of his death January 16, 1898.

Mary died March 30, 1862 at Cow Head, District of St. Barbe, Newfoundland, at age 69. Her body was interred after March 30, 1862 at Cow Head, District of St. Barbe, Newfoundland. Mary has a tombstone in a feild at Cow Head along with two other graves without markers, it reads Mary PAYNE died March 30, 1862 age 69 years. This conclusion may not be correct and was likely based on the incomplete or biased reading of a notation in Bishop FIELD's 1849 List of Inhabitants. The conclusion is also questionable in light of a more recently discovered document, The Last Will and Testament of John BROOK, 1823.
